DGTR Grants Second Extension for Questionnaire Responses in BOPA Film Anti-Dumping Case

The Directorate General of Trade Remedies (DGTR) has granted a second extension for interested parties to submit Questionnaire Responses in India’s ongoing anti-dumping investigation concerning imports of Biaxially Oriented Polyamide (BOPA) Films) originating in or exported from China PR and Thailand.

The investigation was initiated on 24 June 2026. Following an earlier extension granted on 14 August 2026, the questionnaire response deadline had been extended to 28 August 2026. DGTR has now granted a further extension up to 4 September 2026.

Importantly, DGTR has stated that no further extension will be granted for filing Questionnaire Responses, given the time-bound nature of trade remedy investigations.

What Has Changed?

The latest DGTR notice extends the deadline for Questionnaire Responses by another seven days.

Stage Date / Deadline
Investigation initiated 24 June 2026
First extension 14 August 2026
Deadline after first extension 28 August 2026
Second extension 28 August 2026
Final questionnaire response deadline 4 September 2026
Further extension Not permitted

The second extension was granted after DGTR received requests from certain interested parties seeking additional time to file their Questionnaire Responses. After considering these requests, the Authority extended the deadline to 4 September 2026 for all interested parties.

Background of the BOPA Film Anti-Dumping Investigation

DGTR initiated the anti-dumping investigation into imports of Biaxially Oriented Polyamide (BOPA) Films originating in or exported from China PR and Thailand through its Initiation Notification dated 24 June 2026.

BOPA films are specialised flexible packaging materials used in applications including food, pharmaceutical and personal care packaging. Their role in these sectors makes developments in the investigation relevant to producers, exporters, importers and downstream users of BOPA films.

The investigation has also involved procedural developments concerning the Product Control Number (PCN) methodology, including a thickness-based classification framework. However, the present notice specifically concerns the deadline for filing Questionnaire Responses.

Second Extension Granted for Questionnaire Responses

The latest notice records that DGTR had already extended the questionnaire response deadline to 28 August 2026 through its notification dated 14 August 2026.

Following further requests from interested parties, DGTR has now granted a second extension up to 4 September 2026.

This gives affected parties an additional week to complete their submissions.

However, businesses should not assume that another extension will be available.

DGTR Says No Further Extension Will Be Granted

One of the most significant aspects of the latest notice is DGTR’s explicit statement regarding the finality of the revised deadline.

The Authority has stated that, because trade remedy investigations are time-bound in nature, no further extension of time will be granted for filing Questionnaire Responses.

Accordingly, producers, exporters, importers and users involved in the investigation should treat 4 September 2026 as the final deadline for their Questionnaire Responses.

Confidential and Non-Confidential Responses Must Be Filed

DGTR has also reminded all interested parties that both:

of their submissions must be filed on the SETU Portal within the extended timeline and in accordance with the applicable Trade Notices.

This means that parties should ensure that both versions are prepared correctly and submitted within the prescribed deadline rather than focusing only on the substantive questionnaire response.

Who Is Affected?

The extension is relevant to interested parties participating in or monitoring the BOPA Films anti-dumping investigation, including:

Questionnaire Responses provide the Authority with important information required for its examination of matters such as normal value, export price and injury to the domestic industry.

What Happens If a Party Misses the Deadline?

The filing deadline is particularly important because incomplete or missing Questionnaire Responses can have significant consequences for participating parties.

The available regulatory material notes that failure to provide the required information may expose a party to treatment as non-cooperative, with the Authority potentially proceeding on the basis of facts available rather than relying on the party’s own verified data.

Therefore, interested parties should prioritise:

  1. Completing all required questionnaire responses.
  2. Reviewing the supporting information and documentation.
  3. Preparing both confidential and non-confidential versions.
  4. Ensuring consistency between the two versions.
  5. Filing the submissions through the SETU Portal within the prescribed timeline.

Current Status of the Investigation

The latest DGTR notification is procedural in nature.

It extends the deadline for filing Questionnaire Responses but does not itself make any determination regarding:

The investigation remains ongoing.

Therefore, the extension should not be interpreted as an indication of the eventual outcome of the case.

Business Impact

The second extension provides affected parties with additional time to complete their evidentiary submissions, but the explicit β€œno further extension” statement makes the revised deadline particularly important.

Businesses should therefore consider the following:

Producers and Exporters

Producers and exporters from China PR and Thailand participating in the investigation should ensure that their Questionnaire Responses and supporting information are complete and filed within the revised timeline.

Indian Importers and Users

Importers and downstream users should continue monitoring the investigation and assess how any eventual findings could affect their sourcing arrangements and supply chains.

Compliance Teams

Companies participating in the investigation should coordinate the preparation of confidential and non-confidential submissions and ensure that both are uploaded correctly through the SETU Portal.

Management and Procurement Teams

Businesses should remain aware that the investigation is ongoing and that its eventual outcome may have implications for the BOPA film supply chain. However, no conclusion on duty has been made through this procedural notice.
