The Department for Promotion of Industry and Internal Trade (DPIIT) has issued the Cookware, Utensils and Cans for Foods and Beverages (Quality Control) Second Order, 2026, notified as S.O. 5624(E) on 13 October 2026 (Gazette No. 5410). It makes BIS certification for aluminium utensils mandatory with immediate effect. For aluminium beverage cans, the deadlines start from 1 April 2027.
If you manufacture or import wrought aluminium utensils or aluminium beverage cans, this Quality Control Order (QCO) applies to you.
Background
The Order is issued under Section 16 of the Bureau of Indian Standards (BIS) Act, 2016. It supersedes the earlier Cookware, Utensils and Cans for Foods and Beverages (Quality Control) Order, 2026, except for things done or omitted before the supersession.
What the Order requires
Goods listed in the Order must conform to the relevant Indian Standard and carry the BIS Standard Mark under a BIS licence, as per Scheme-1 of Schedule-II of the BIS (Conformity Assessment) Regulations, 2018.
Products and implementation dates
| Product | Indian Standard | General manufacturers | Small enterprises | Micro enterprises |
|---|---|---|---|---|
| Wrought aluminium utensils | IS 1660:2024 | Immediate effect | Immediate effect | Immediate effect |
| Aluminium cans for beverages | IS 14407:2023 | 1 April 2027 | 1 July 2027 | 1 October 2027 |
Micro and small enterprises are as defined under the MSME Development Act, 2006. The latest version of each Indian Standard, including amendments notified by BIS, applies from the date of notification.
What is exempt
The Order does not apply to:
- Goods manufactured domestically for export.
- Goods imported into India filled with material in solid, liquid or gas form.
- Up to 200 imported units per year for research and development by manufacturers. These must not be sold commercially and must be disposed of as scrap. Manufacturers must also keep year-wise records and furnish them to the Central Government.
Declared stock
Goods made or imported before the implementation date by a BIS-certified manufacturer, a manufacturer who has applied for certification, or an importer may be sold, displayed or offered for sale for up to six months from the implementation date. This requires a Chartered Accountant-certified declaration submitted to BIS.
Who is affected
- Manufacturers of wrought aluminium utensils (all enterprise sizes, now)
- Manufacturers of aluminium beverage cans (from the staggered 2027 dates)
- Importers of both product categories
- Micro and small enterprises, which get the later dates for cans
Domestic manufacturers who make only for export, and importers of filled goods, fall outside the Order.
What has changed from the earlier 2026 Order
Utensils (IS 1660:2024):
The earlier Order’s table showed 1 October 2026 for general manufacturers, 1 January 2027 for small enterprises and 1 April 2027 for micro enterprises. The new Order applies immediately to all three categories.
Beverage cans (IS 14407:2023):
The new dates are 1 April, 1 July and 1 October 2027. The earlier table printed one set of dates against the utensils row, and the cans appear to have shared them.
Penalty:
A new clause makes contravention punishable under the BIS Act, 2016. The earlier Order had no penalty clause.
Supersession:
The new Order supersedes the earlier 2026 Order itself. That Order had superseded the 2025 Order only as it related to these two products.
The exemptions are worded the same in both Orders. BIS remains the certifying and enforcing authority.
Status and enforcement
The Order is final and notified, and in force from the date of its publication in the Official Gazette. BIS is the certifying and enforcing authority, and contravention is punishable under the BIS Act, 2016.
What businesses should do now
Check whether your products hold a valid BIS licence for IS 1660:2024. If not, start the application immediately.
Work backwards from your 2027 deadline. Factory inspection, product testing and licence grant take time.
Confirm that your overseas suppliers are BIS-registered or licensed for the relevant standard.
If you plan to use the six-month declared-stock window, prepare the CA-certified declaration in advance.
